first, you are not suing your parents but their insurance company. if they do not have tort insurance coverage, i'd think twice. by the way, time is slipping, pardon the pun. as spring approaches, that ice is quickly becoming becoming a memory. got hurt on something that doesn't exist any more? act fast, mon amie. there is a time limit and you may have passed that point. any injury you claim now could be explained by others as a injury of another source or old and still not sue-able!

You will not be suing your parent's insurance company. Their insurance company is not legally liable for your injuries. Why haven't you gotten your sorry butt off the couch and cleaned those gutters before it getting to this situation?
BTW, your suit would be against the property owner's Homeowner's Insurance, not the parents sepcifically, unless you were suing for more than the limit of liability or you were asserting criminal negligence on their part. Then they could be sued personally.

2. even if they were your enemy, you know it's winter and stuff freezes- we all have slipped on ice before, yeah, it sucks but be more careful next time
3. Most states have a rule that you can't sue for slipping on ice anymore

I think your asking if you should try to file against their homeowners policy,and that even they have encouraged you to file.In some states persons residing in the house are not allowed to file against the homeowners liability insurance policy,in some they can. I think you should consult an attorney or probably first talk to your parents insurance agent and they can explain if you can/cannot file (most are really pretty honest people and willing to help all they can). Some times immediate family even residing elsewhere cant file either..you probably wont have to sue anyone ,just file a claim ,if your eligable,usually the company pays off without any lawsuit recuired.

Sue your parents? Of course not!
But make sure they know that if someone else slipped, they could be sued, and more importantly, they could be injured themselves. Please advise them that they should get the gutters cleaned, and they should use salt or something on their steps when it gets icy.
