Have a court case coming up . have some questions?
|
I recently had filed charges againest a girl for calling and harrassing me and then leaving two threats and death messages. I recently got a letter giving me a court date and it says "state of maryland vs the girls name" what exactly does this mean? I know the girl that left the messages and she called to apologize and stuff. Can I drop the case? or no because it is the state versus her? Little help because this is the first time I ever had to do something like this. Additional Details I have the saved phone calls and voice messages she left. I honestly dont need this childish crap, I dont understand why people cant act their age.

If the dispute is settled outside the courts then you should have no problem dropping the case with her. However, if it is against the state then the state has decided that the issue is so inflammatory that this girl now has a problem with the state, not only you.
Personally I would consult a lawyer to get the full details

Harassment and terroristic threats are against the law. Just as theft or assault, all crimes are handled by the prosecutor.
If this were a civil lawsuit, it would be "Smith v. Jones". In a criminal prosecution, it is "State v Jones".
You are a witness at this point. You will be asked questions to help the court and, perhaps, a jury, to understand what happened and who did what. Think before speaking and answer with the truth as clearly and briefly as you can. The prosecuting attorney will likely discuss the matter with you just before the trial.
Many trials are settled at the last minute with a plea agreement. That will mean that no trial is necessary.
Because you did the right thing in reporting this crime, the people of your community are a little safer. Thank you.

The state has taken over the case. You can put in a request that the case be dismissed, but chances are it won't be.

You need to contact your local District Attorney since they handle the "State vs." cases. But consider, is the girl apologizing because she is truly sorry or is it because she doesn't want to go to court? And as soon as you drop the charges will she come back after you again?

Yes the state prosecutes crimes, and what she did is a crime, You are being summoned as a witness and you cannot drop the case because it is the state's case not yours.
