Well, speaking in terms of the law, yes. The doctor then would be refusing to do his duty as a doctor and could lose his license. Now thats saying another doctor wasnt able to perform it there because then they would just get another doctor to. It really would depend on how much of a b**** the women was about it. More than liekly the women would hear that he refuses and just ask for another doctor, but the women could then press charges if she had to be reassigned to another hospital and something went wrong. He would then be sued for metical malpractice, but there isn't any specific abortion law for it.
Ethically speaking, I say the doctor has full rights to not do it just as much as the women has full rights to have it done. To me, if she has the right to kill her baby, the doctor has a right to not wanna kill it, plain and simple. If you take a doctor to court for not perfomring an abortion would make you seem just as stupid as someone taking another to court for not believing in god. Their only case would be that they don't believe in the same issue as she does, and that to me is completely wrong!

You are saying that you agree that it is illegal for a doctor to refuse to perform an abortion. It is not illegal for a doctor to refuse this. Performing abortions is not something a doctor has to do. For one thing there are many different types of doctors, not all doctors would even be qualified to perform abortions. So, it cannot be illegal to refuse this. Now if a woman went into a medical facility and was having life threatening problems because of a pregnancy a doctor would have to stabilize her condition to try to prevent her from dying. This does not mean he would have to terminate the pregnancy. Just because it is legal to do something does not mean that everyone has to be willing to do it. Hunting is legal, but it is not illegal to not hunt. Trying to say it's illegal to not perform abortions would be like saying just because abortion is legal it's illegal to have babies. See how rediculous that sounds.
A doctor cannot lose his liscense for refusing to perform an abortion. And as far as for the Supreme Court ruling that a doctor cannot refuse on the basis of his religious beliefs, he doesn't have to say why. He can refuse to perform the abortion and not have to say it's because of religious beliefs. Of course, the whole problem is people these days want to file lawsuits for everything. And I think judges and even Supreme Court Justices have become scared to say what they believe so they grant all kinds of frivolous lawsuits to people without proper cause. Abortion may be legal now, but the majority of abortions legal or otherwise are still performed for people who did not have enough self-control to not have sex. And all these abortions that are being performed for people between the ages of 15 and 21 could have been avoided if these children would have just not had sex. As for people over 21, it is possible to have sex without getting pregnant. There are steps that responsible adults can take. And it's also possible to just not have sex as casually as most people seem to. And, I'm talking about males and females. Yes it's the females who have to have the abortions or have the babies, but the males need to learn just as much self control. And I know that the popular thought is that boys will be boys. Well, ask yuself why? Are people really saying that males are like animals who have no control over their actions? Are people saying males are ignorant?

Only if the pregnancy risks the life of the mother. Also, just a few months ago a ruling in the supreme court stated that they cannot refuse to do the procedure based on personal religious beliefs.

It's up to the Doctor what he wants to do or not do. Unless he's an emergency room physician, and it's a life or death situation, then I think he's obligated to save the life, (of the mother, if that's the situation)

No, a doctor may refuse to do anything. A doctor is not bound to remove a splinter.
A doctor is required to perform to the best of his ability IF he /she gives care.

No, because it is a personal service and is not required by law. On the other hand, as with the pharmacists that are refusing to fill birth control or RU prescriptions, the oath of providing health services should obligate the doctor or pharmacist to know how to advise the patient - which doesn't mean "Travel 50 miles to Burg, there may be someone there."

No it isn't....My brother knocked up some 17 year old and she tried to go and get one and they refused not because her guardian didn't consent but because she was upset about it and didn't want one.

That doesn't make sense. An ear nose and throat doctor can refuse to perform surgery on your brain, because that's not his/her area.

No, I don't think a doctor is required to perform anything like this.
You simply need to find one who supports this.

Uh.... Why would it be illegal for a doctor to NOT do a specific procedure, especially one that is harmful to a human?
You an always go somewhere else and find another doctor, you know?
I personally know of an OB/GYN who is Catholic, pro-life and does not prescribe birth control of any kind beyond "natural family planning" and the obvious - if you don't want to get pregnant, don't have sex (that's called abstinence). I doubt that doctor would perform an abortion.

No it's not illegal for a dr. to perform an abortion, however, most abortions are performed at abortion clinics, therefore...I would think it would be difficult to find a doctor that would not perform one.

No. Just because it's legal doesn't mean it's mandatory.
And if a law was passed making it mandatory for the doctor, how long until another law would be passed making it mandatory for some mothers?

Not at all, it's a service they choose to provide or not to provide. Plastic Surgery is "legal" but you can't force a Doc to do it.

A doctor or nurse has the right to refuse to take part in abortion on the grounds of conscience, but he or she should always refer you to another doctor or nurse who will help.
The General Medical Council’s Duties of a Doctor says that doctors must make sure that their “personal beliefs do not prejudice patient care”.
The Nursing and Midwifery Council’s Code of Conduct provides similar guidance to nurses.
also if you are too far along they will or at least should refuse abortion.

No. A doctor can decide what operations he/she is willing to perform. If the doctor doesn't perform abotions, find one who does.
A doctor can refuse treatment for any reason. My Ob/Gyn won't treat a pregnancy in a women over 35. The risks are too great and she doesn't want to responsibility of what can go wrong. She will refer you to someone who will treat you, but personally she won't.

Smoking is legal. Is it illegal for a doctor to refuse to smoke, or refuse to give you a pack of cigarettes?
