I know police can effectively hold people without trial?
|
So what makes a police officer do that. Like what makes police say we are going to hold this guy in jail for 5 years cause he made some threat but the murderer will get a trial and post bail? Additional Details I watched a dateline or 20/20 about a whole bunch of AMERICAN guys mostly white locked up without trial for like 5 years for making threats about nukes and stuff

In the US, they can hold you for 72 hours without charging you. Then they can hold you until the preliminary hearing where you plead guilty or not guilty before a judge. Then your attorney asks for bail.
At this point the police hold you or let you go with a court order, not on their own. Of course they can abuse their power and hold you, but that is not the legal meaning of due process.

Never happened in Canada so can not answer. When you are arrested we have 24 hours to lay a charge and then can request a bail hearing to hold you until we finnish the investigation. Many conditions must be met to hold you until trial.

I did not know that police can hold anyone in jail. If an attorney get involved, they have to adhere to the law and release the person- right? wow. that sounds crazy if it's true. I thought police officers can only arrest and place someone in temporary holding cells.

That would be impossible to answer without the details. There has to be more to it then a simple threat.

Police can only detain someone. Only a court of law can keep them locked up. You would not be locked up for five years without a conviction, as it would be a violation of your Sixth Amendment right to a speedy trial.

In the US? I could not hold a guy I knew did murders or anything else for more than 72 hours while doing an investigation unless I got approval of charges from the county prosecutor. He went to court the day after approval.
You might be talking about staying in jail for a long time while awaiting trial but that has to do with continuances of the court proceedings. In most cases that cannot go on for more than 120 days in custody, out on bail 180 days) unless the continuances are requested by the defense.
I did have one trial not go one for almost 4 years but that was because the bad guy's lawyer kept getting continuances so the main witness would die, it turned out the judge granting the continuances was on the take.
Simply what you are saying does not exist or is mispercieved.
