Drunk in public, pertaining to riding in a car.?
ive always noticed on cops that when someones pulled over. they ask the Passenger to get out of the vehicle and then arrest them with a drunk in public. can you get a drunk in public in your vehicle? or do you have to be outside of it?

im just curious. i mean, hate to have my buddy driving my home from the bar or a party, get stoped, and get slapped with a drunk in public. because i watch them tell you to get out of the car, (which if you told them NO, you'd get resisting or something stupid i would suppose) and then when there out of the vehicle there arrested?

If the vehicle is being operated on a PUBLIC roadway, and the occupant is intoxicated, he or she can be arrested for PUBLIC intoxication.

Period.

If you are in a vehicle on a public street, you are in public. Your car is not a private house.

There are actual laws here in California that are being enforced, that make it a crime to be drunk in a taxi-cab. Yes, I'm serious.

That is the stupidest idea for a law ever.

Though they would need a reason to pull the driver over in the first place.

That is also when I never drink anywhere I would leave when I drink. Bars are stupidly expensive, so only at friends or my own place.

Essentially it would make it illegal to drink at all, if you can't be drunk in public, they might as well wait outside the bar and arrest people walking out.
