As you were in charge of a moving vehicle it would be deemed to be your fault, although it could be argued that the illegally parked car may have contributed to the accident. I believe that the rule is that you have a duty of care to the other person's property, even though the other driver had parked on a double yellow. This would be a case for the insurers to argue anyway.

Certainly it is. Same as it would be if you hit it in a car park, on someones drive, etc etc.
There would be mitigating circumstances possibly if it was dangerously parked - but that would be hard to prove.

gomanyes is correct...if you saw the car and hit it or even if you did not see the car and hit it, you are majority at fault. your insurance company will apply liability on the other car however. probably anywhere from 20-50%.

If you hit a stationary vehicle, it is your fault whether it is legally parked or not.

Yes, it doesn't matter where anything is parked or setting, if you can see it in front of the vehicle and you know that it is there and you still hit it even by accident it is still considered your fault becase you are the one who hit it.

Yes, because you are at the controlls of your own vehicle and should have observed the hazzard of the illegally parked car and either slowed down or stopped.

Yes you hit a PARKED CAR.
Why wouldn't it be your fault? Had you been paying attention and maintaining a proper look out, you would have seen the parked, stationary car.

"If you hit a car which is parked..."
Absolutely your fault. If you can't keep yourself from hitting a parked car, then stay off the road!

You are to blame even if the car was parked on double yellow lines. It could have been a disabled drivers car, could have been a broken down car, theres no two ways about it, its definately your fault

In the UK you are required by law to drive at a speed which would allow you to stop within the distance you can see.
According to the law, if you hit a stationary car, either you were going too fast or you were not paying attention, either way you are guilty.

If you were able to avoid it but did not....you are at fault. Just because someone is parked or stopped where they should not does not make it OK to run into them.

If you hit anything which is IN FRONT of your car, it is always - at least partially- your fault.
The object was so close that it was within your braking distance . Of course it's your fault.

If you hit anything, it's your fault. The fact that it was parked illegally is a mitigating factor which may lessen your liability, but you're still at fault.
