If I have no car insurance & am involved in an accident that is not my fault who pays for the damages?
2 days ago a crazy elderly lady with full coverage insurance thru The Good Sam Insurance Company tried to pass me over a double yellow line and lost control of her vehicle and slammed into the drivers side front tire and pushed me off the road into barbwire . My 1985 318i BMW plowed through 34 feet of barbwire and 7 heavy metal T-posts. I wasnt hurt at all just shook up and same with her but my car is history!!The CHP came and did a report and gave me the womans name and insurance company and policy #. I didnt have any insurance so my question is , will her insurance company pay for my damages since it was her fault? and should I get an attorney ?

Did the police charge her with any traffic offences? - if they did, that will be in your favour. You should be able to claim all damages to your vehicle through her insurance.
The Good Sam Insurance Company? You cant be fair dinkum - that has to be a furphy :)
To be serious now - if what you say is true and correct, you should have absolutly nothing to worry about.
Dont give your money to those sharks until you have an answer from her insurance. LOL Good Sam.

Since you don't have any insurance you are at fault, she could possibly sue you for damages on her car. Why don't you have insurance? This is a hard lesson learned.

you should get a lawyer because you won't be able to get anything if you don't go fight for it.Just a thought you might want to also think about when you get your money get some insurance while you've got the funds and never go with out it because what if the tables were turned you'd be screwed wouldn't you?

If she is proven at fault, her insurance will pay for your car minus whatever would be the most expensive deductable.
However... keep your eye on the mail because you WILL recieve a summons to appear in court and WILL face a severe fine for not having car insurance.

I was in a similar situation about a year ago. The guy who hit me was cited. His insurance company did come out and appraised the damage to my car and wrote me a check on the spot. Yes, pursue this!

it is illegal to drive a car without insurance so you have no right to ask for compensation

may be you are lucky if her insurance company will not let you to pay her all the damages of her car

If you mean that you had no insurance at all, you may be a long time waiting for any payment. Some states have "No play, no pay" laws that limit or restrict the ability of an uninsured driver to recover from the responsible party. In some states you can only recover personal injuries and in others you can't even get that.

One of the benefits of having insurance is that in a case like yours, your insurance company will assist you in recovering your losses. Since you don't have insurance you'll have to hire a lawyer at your own expense to have much chance of recovery.

Don't exepect her insurance company to rush to settle. They'll likely take the position that you should not have been on the road in the first place since you were uninsured and if you had not been on the road you would not have been involved in the wreak.

On top of that, an 85 Bimmer isn't going to be worth much at all. A couple thousand if you're lucky. It's very likely that it will cost you more that that in attorney's fees alone.
