we rolled behind into the other party's car in a rental car (we took out the CDW insurance) at the time we exchange insurance information. I called my insurnace and made the claim. A year and half later the other party never followed up therefore, no money nor repairs were reported from either side.
Now!!! I'm shopping around for auto insurance and I am being pentalized for making a claim and the insurance company didn't have to pay for anyhting. My insurance has gone up at least 25% for that claim. Does anyone know if I can get the remove from my insurance company and how long does a claim stay on your insurance?? Additional Details Thanks for all the feedback...my insurance is held in Las Vegas, NV.

I'm not sure what state you are from but here in New Jersey accidents are "supposed" to stay on your record for 7 years.
I would contact the insurance company's claims department and explain your situation to them. It isn't fair that they should make more money on a claim that cost them nothing. If you don't get anywhere, or if the operator gives you a hard time or is not courteous, ask to speak to the person's supervisor. It doesn't hurt to try, and you might be able to sweet-talk your way out of the higher premiums.
The only other way would be to either hire a lawyer, or if you have a friend, (or a friend of a friend lol) that happens to be a lawyer, have them type up an official looking request asking them to return your premiums to normal. I had a lawyer friend do this for me once, and it worked.

once you've filed there is no way to remove it; you have to wait it out. the general wait time is 5 yrs. you are being charged for this claim because you are a greater risk now that you have filed the claim. and this is whether the accident is your fault or not.

Insurance claims last 4 years on your driving record. Unless you want to have repairs done to your car don't report the incident...I know this is bad advice. You are being penalized because you were in an 'at fault' "accident" not because the insurance company paid $$$ out.

Since there was no payout, I don't see what the new insurance company is penalizing you. That's usually how they determine the rating. See if you can get a letter of experience from the old carrier that may influence the new carrier. If the new carrier doesn't accept, you may need to try another carrier.

well it all depends on the state you live in as to how long the claim is rated for on your record, the normal is 5 years, however if you made a claim and there was no pay-out to the other party than that claim would fall under the " collision claim under the state threshold" which means your insurance should not be surcharged for it..... i am an insurance agent and deal with this everyday, there is no way you should be getting charged for that accident...... the best thing would do is to get a hold of the old company and ask for a written statement saying that they didn't pay-out anything on the claim and then present that to your new insurance company and you may have to bring that into dmv to show them to update your records as well, i hope this helps.... if you need more info on insurance let me know!!!

When you get in an accident and you're at fault, your insurance goes up, even if the insurance didn't pay out.
This is because they raise your rates not to get their money back, but because your driving record shows that there's a higher chance that they might have to pay out in the future. The fact that they didn't pay anything in this case doesn't matter.

You will be penalized for the claim for 3 years, and will not qualify for many discounts for up to 5. Unfortunately, unless you had called to cancel the claim, it will stay on your record. You may want to try calling the insurance company you made the claim through, and see if they can still cancel the claim as no $ was paid out.

You didn't make a claim, you reported an accident where you were at fault so they would be prepared when the other party claimed against you. You are fortunate the other person didn't follow through, but that doesn't change the fact that YOU caused an accident. It will be looked at for three years from the date of the accident, and then drop off.

this will stay on your "record" for 3-5 yrs depending on your company. if you deal directly with your company for a claim, they file it. you should ALWAYS contact your agent to discuss if a claim should be filed. the agent will not file a claim unless you tell them to. this avoids a lot of these situations where you may just want information on filing a claim. unfortunately in your case you did the right thing by filing this since you were at fault. the person you hit has up to 3 yrs to file and get money from your company, so they will keep it as an open claim for at least the 3 yrs.

An at fault loss is an at fault loss whether money exchanged hands or not. The CDW covers the damage to the rental, your liability coverage pays for damage to the other car involved. No you can't get it 'removed' from your CLUE report, what you can get is a 'Letter of Experience' showing any claims and what was paid out under the BI and/or PD portion. This may or may not help, but it's worth a try. BTW...in NV, the other person has 3 years from the date of loss to present their claim--but this has no bearing on fault. Also in NV claims follow you for 36 months.
