I'm a teen that was hit by an 18-Wheeler. Help?
|
This morning I was rear-ended by an eighteen-wheeler on my way to school. I was pulling out from a yield sign and I had seen it way up ahead on top of the hill so there was plenty of room. I pulled out and the driver had actually been speeding. I looked in my rear view and he was so close that I couldn't see his windshield then he hit me. My car isn't too messed up, just dented pretty bad on the back left bumper. His boss showed up with the cops and started taking pictures of my car. The truck only had a tiny dent. I am also 16 years old so does anyone think that they might sue me or something and pull some crap like I wasn't paying attention or whatever and take advantage of me just because of my age? What should I do?

Because HE hit YOU you do not have much to worry about unless you do not have Auto Insurance. If you do not have liablity coverage and your state requires you to have it you could be found at fault no matter who hit whom. However as long as a vehicle hits someone from behind, the person that was in the behind position is the one found at fault. It was his responsibility to stop. There was nothing YOU could do to avoid the accident. The most important thing is for you to make sure you have his insurance information and for YOU to call the insurance company immediately. Do not wait. The sooner you start the process and get the insurance company to order police reports the better. If you do not have full coverage then you should call his insurance company. If you do have full coverage then you call your own insurance company. If you call your insurance company and you have full coverage it is their responsibility to investigate the claim. You have to do nothing but answer a few questions by giving a statement. They may ask you to take your car to a shop for a estimate but then depending on your insurance carrier they might have someone come to you to get a estimate on damage. If you have a deductible they may ask you to pay that to get your car fixed but once the other drivers insurance carrier has investigated the claim your insurance company will make against them and they decide that their driver was at fault they will reimburse you for your deductible.
Just a added note. Make sure you call the DMV to report the accident, Especially if damages were more than $700.00 Even though the police were there and they filed a report they do not always send it to the DMV. If the DMV finds out you did not file a accident report with them within 10 days of the accident you can and will loose your license for a year because you did not report the accident.
I hope this helps.

How would you not paying attention cause someone to rear-end you? It sounds more like HE wasn't paying attention or he would have stopped. It's a yield sign, which means you have to yield. If he hit you, he probably wasn't even going to yield at all.
I don't know that I would sue for more than just getting your car fixed, unless there is something terribly wrong with you, or if you have resulting hospital bills. There's too much of that "Get Rich Quick" mentality out there - people are so sue-happy!
I hope you got all of the insurance and registration information. You may need to get a copy of the police report for your insurance company, or whoever's insurance company is going to pay for the damages. BTW, the police report will tell who the police feel is at fault. Even if it doesn't say it outright, you can tell by how they explain what happened on the report.
Is either one of you being being charged with anything? If so, that should make the determination as to who's insurance will pay the bills.

as long as you were following the law, and you have insurance you should be fine. My mom was run over my a big rig too. She was fine but the car was a mess. The driver said it happens, big rigs can't always see little cars right in front.
You should be fine but call your insurance company and make sure your side of the story is heard

Well be glad that the cops came and a report was filed. Was information exchanged? -Did you get his name, his companies name. I would look at the reports you can go to that police department and obtain them. I would then call your parents (since I'm guessing your on their polcy) and inform them, they should call and report it. Then expect to be questioned by your insurance company.
To me, (have worked in insurance before) you are lucky if you aren't charged with something. Your rates will go up regardless if it was your fault. It sounds like you did not have enough room. It also depends on where the impact was. It does not matter if he was speeding-he shouldn't, we all shouldn't speed but we do it anyways. It takes longer for 18 wheelers to stop and to me it seems as if you did not want to be behind a18 wheeler. which i don't blame you they aren't fun to be behind. he probably couldn't see also since you claimed her that you were on top of hill-if he was coming up he was probably expecting that you knew he was coming and vice versa. The visibility was poor there.
There are lots of factors that we would need to know to form a better opinion and that's what mine is an opinion. I'm sure some will doubt my answer or you might get upset but its my opinion.
OH AND THESE PEOPLE CLAIMING THAT YOU SHOULD GET A LAWYER AND SUE THEM FOR ALL THEIR WORTH. THESE ARE THE PEOPLE REPSONIBLE FOR THESE UNREASONABLE PRICES THAT WE HAVE TO PAY FOR INSURANCE. Your insurance company takes care of everything and if their is a need to sue like for example if the truck driver was found liable and the company won't pay your insurance will file suit-not you! You need to go through the insurance company. Don't be greedy-accidents are just that accidents there was no foul play from either party and no need to sue unless the party responsible for the accident will not pay up.

" I was pulling out from a yield sign and I had seen it way up ahead on top of the hill so there was plenty of room."
No, there wasn't, obviously. You had a sign that said "YIELD" and you didn't. That puts you primarily at fault here. Now if he was speeding that may reduce your liability by a percentage, but I would guess you are still at fault for the most part.
But you don't need to worry since your insurance will be representing your interest and paying if there is any liability assigned. Just notify them, and make sure they get a copy of the police report.

If the police were there, then they will have filed a police report. You need to notify your parents and your insurance company about the accident. You will also want to get a copy of the police report.

It seems some of the people answering didn't read your description, this accident was clearly your fault. You can't even make the claim that you knew the truck was speeding - because if you saw it was speeding, why would you have proceeded through the yield sign into its path?
Your insurance will pay for the damage to the truck, and also to your car minus your deductible (assuming you have collision). I don't think you'll get sued, it's not likely the truck driver was injured from such a minor accident - so if the cop didn't give you a ticket, the deductible will be your biggest worry, although your insurance rates might go up.
Chalk it up to experience - next time really make sure there was enough room, there clearly wasn't this time.
Good luck!
