Hit and Run rental truck?
I was involved in a hit and run accident. The other person was driving a rental moving truck. He turned left in front of me and I hit him totaling my vehicle and hurting me. He left before the police got there. The vehicle license plate and co. were identified. I have good ins. and am being taken care of that way. My question is: If they cant find the driver, is the rental co. liable?

Why would the rental company be liable?

They weren't driving anything.

If I took your car and hit someone with it....would you be liable for my bad driving?

No.

The rental company, as a business, could be held vicarious liable for the damages to your vehicle, but it varies from state to state. In some states, the rental company could be held liable if they knowingly rented a vehicle to a driver with a poor record.

The most common situation however, is employer/employee. If your insurer feels they can recover from the rental company, they will most certainly attempt to do so.

The liability lies with the driver , You sound like you want the rental companies deep pockets to sue.Let the police and your insurance handle it. You need to concentrate your efforts on healing up and returning to work. You will not make money off the accident.

The rental company IS liable. They are required to carry liability coverage on the rental truck. Your medical bills will be covered through their insurance. While it is the drivers fault, his insurance will not cover anything. Auto liability insurance does not transfer to rental moving trucks. You'll need to file a claim with the rental company. Depending on the company I can get you the information that you'll need to file a claim. Good luck
