Car Crash was it my fault?
If I was involved in a collision wherby I hit a vehicle which had undercut me on the inside lane because I didnt see it because of my blindspot who would be liable: Given it was a 40mph speed zone and I was travelling 40mph when I started to pull into the inside lane?

not your fault i drive a truck in edinburgh and taxis have a habit of speeding along the bus lanes i cant see them and regularly put them on the pavement because if i hit them they dont have a leg to stand on

i'm afraid you were the car in the inside was travelling lawfully you entered his lane when it was not safe to do so all cars have blind spots thats why you should check over your shoulder and indicate in plenty of time before making any manouver of this kind.

Were you changing lanes? Was that car in that lane already and you didn't see it? If yes to both, then you are at fault. Blind spot or no blind spot, doesn't matter. If the other person already had possession of that lane, he is not negligent for being there and not being seen by you.

It was both ur faults! like someone has already said! he shudn't of been undertaking, but then again you shoudn't have been sitting in the right hand land, and going slower than the inside lane! but you should have looked at your blind spot! if i was ur insurance company, i wouldnt cover you!

If you were being over taken on the left hand side/passenger side of your car (ie you're driving a left hand car in the UK), then it is the other guys fault as it is illegal to overtake on the (inside) as we say.
If however you were hit on the right side (drivers side), and you were pulling into the outside lane, then it is your fault. You always have to check your blind spots (even a quick look over your shoulder) prior to any manoeuvres

You say the speed limit was 40mph and you were doing this, what most people forget is that although a sign denotes a speed limit, this is only the maximum guide, you do not have to drive at the maximum speed as any speed under this is sufficient enough.

No way is it your fault. The car in the inside lane should have been watching for what you were going to do. The only way, if what you say was true, that you were doing forty miles in a forty mile zone, that they could hit you, is if they were speeding.

Under taking is illegal in the UK, it is not in some countries.
You do not have to indicated to move into lane 1 as the police call it or the left hand lane as we call it.
I don't think the police would find you in the wrong, and I would dispute an insurance claim from the undertaker (no pun intended). But I don't know for sure, as you were the one who manoeuvred.

you say you were undertaken, on what sort of road?

If it was a one way street with a left and right turn at the end that is quite proper if they intended to turn left, and you appeared to be going right or straight on.

As it was you making the lane change I'm afraid it is down to you to make sure it is safe to do so, you didn't, your fault.

Not necessarily your fault. If you can prove the other dude was breaking the law (speeding on the inside lane) you have a good case. I've heard it said that if you have an accident thats totally your fault but the other person was breaking the law in some way like has no insurance or MOT or was speeding etc you can get off.
