Fred C	No. Your insurance company will repair your car and sue him, they have the sole right to subrogation. He cannot be sued by you for damage recovery for the same accident the insurance company is suing him for. If you didn't purchase loss-of-use coverage, then you have indicated you were prepared to live without a vehicle for a while, in which case the rental of a vehicle would be classed as a personal choice by the court anyway. You can ask your insurance adjuster if they will add a month's rental to the suit, but, since you had no coverage in place for it, I doubt they will, or even legally can. Sorry. All those that say go ahead and sue should read their policy wordings. Your policy assigns rights of subrogation to the insurance company. That means they have the right to sue for any and all damages they pay out as per the policy, not you. Edit Jan 23 If your claim is handled under uninsured motorist cover, it doesn't matter that the other driver has no insurance, that is what the uninsured motorist cover is for. Your insurance company can still sue him, probably has already, and you are not part of that action. oklatom	Start by asking him to pay for your losses. If he refuses, you have the right to sue, but doing so might be throwing money away. Evaluate first.
