She should of evicted him. You were part of the problem but he should be the one getting kick out. But any who, If she evicts you, you need 30 days and if a sheriff brought you the eviction notice than depending in your state, which it should be almost the same, you have to go to court first then she can evict you. read your lease , it is very much possible you could be evicted in 3 days , happens all the time . that is usually the time they give you , but read your lease to see the terms of evictions

listen if he files with the court systems u have time. for them to put an eviction notice on the door for 72 hours they had to take u to court a few times and you didn't appear. if i were u go to the court today and explain your case. good luck.

Unfortunately, having kids has no bearing on the intial eviction process. However, I don't know of any states that allow for 3-day evictions. You need to research your state rental laws to determine what timeframe you are facing and what protest rights you may have.
BTW, a bit of kind advice. If you are that worried about your kids, try to remember the big picture next time you are thinking of becoming involved with someone.

Your best bet is to call the court system in your town and find out if they can do that to you. I think it may be an illegal eviction three days notice is just crazy.

3 days doesnt sound right. if you didnt violate the contract and you are within the contract, then you have every legal right to stay. I dont think any contract cautions of sleeping with the leesor, lol.

In my state you absolutely can be evicted in 3 days, but only for non-payment of rent. If you don't have a written lease, and they want to end the tenancy, they have to give you 30 days notice. They can also kick you out for damage, criminal activity, etc.
But the bottom line is, in any state, THEY CANNOT EVICT YOU WITHOUT GOING TO COURT. Don't just roll over and take this abuse and move out. Force the issue - don't move, don't pack. Chances are he doesn't want to drag this situation into a court room. And if he does, it will be clear to the judge why he is evicting you and it won't stand.

The landlord cannot evict you, only the court can. You should have been presented with a notice to go to court. Get a lawyer immediately to step in and settle this.
