Technically you have the right to brake at any time. If the guy in back of you is following too close to react, and hits you, it's his fault.
You could always say a rabbit ran in front of your car.

In most cases yes, bc you are the cause of the accident. But in other cases no because they hit you from behind. In either case each might be ticketed.

I do that all the time to show them a lesson and 99% of the time they get off my back. I hate it when people tailgate .......especially when you have a line a mile long in front of you and the dumb idiot behind you thinks you are going to move for him/her.
The law in CA. is that you are not suppose to tailgate and you need to give yourself enough distance from the car in front of you to stop. In California it would be hard to find the driver who braked guilty, because the driver who hit the other car from behind is always at fault.

Tailgating is illegal. Why? Because sudden or emergency stops will cause an accident. Are you claim the person in front stomped his brakes for the sole purpose of causing an accident? Even if this is true, it is your word against theirs. End result: tailgater is at fault EVERY SINGLE TIME. THIS IS THE LAW. STOP TAILGATING!

No, the wreck is not your fault.
The driver behind you is at fault. Why? For the simple fact that LEGALLY, he/she is supposed to be 1 car length away from your bumper for every 10 mph.
Failure to follow this rule WILL be the reason for the wreck. The "I didn't have time to stop" excuse won't flow.

If someone hits you from the rear, the presumption is that they are at fault. The law requires that you maintain safe control of your vehicle at all times. You must not exceed a safe speed, or follow too closely.
The charge for hitting someone in the rear is usually "failure to reduce speed to avoid an accident"

No, they should not be tail-gating you (following too closely) and be unable to stop on time. You might have to stop suddenly for various reasons. Vehicles following must maintain a safe distance.

A person who tailgates is the one taking the risk...A person may have to slamb on the breaks for anything. Some people will slamb on the breaks for a bird!! Never tailgate..Always stay 3 car lengths behind...

"Driving to endanger" is tough to prove. Most rear-enders are the fault of the person doing it. If they were travelling as a safe distance and speed, they would have been able to stop. The law does not recognize the possibility of tailgating for legitimate purposes.
